Yeah that makes perfect sense and in a perfect world that would work. But in a world where money is everything they are going to milk AS MUCH time out of you as they can. So even IF they allowed you to level old gear up they would most likely make such an item an endgame drop so you would STILL have to use the new gear for awhile before you can switch back to the old.
