....You really aren't getting the point. The customer paid for everything in the instance/disk/download/whatever you want to call it, they paid for it. Just because it's technically legal, doesn't mean it's right, or in the customers best interests. You're right about what they'd do if this was a post that could be presented in a court of law though. Just shows how scummy the AAA gaming industry is unfortunately. Heck, they probably are doing it.
But, regardless, making the DLC before the game is complete and not including it (again unless it's game breaking or incomplete) or making it intentionally inaccessible despite it being finished isn't justified.
