Sex offender flees to Canada and gets granted asylum?

A school faculty member in their 40's, has sex with a 16 year old student who is also a friend and teammate of their teenaged child, is tried and convicted of 5 counts (with DNA evidence that the crime occurred) and is sentenced to 30 years. I do not know if those 5 counts resulted in consecutive mandatory sentences or not. The total sentence was however, 30 years. While out on bail, they flee to Canada and make an appeal to the Canadian government that they not be extradited back to the US to serve their prison term because the 30 year sentence is "cruel and unusual". Those are the facts of the case, with some specific details left out before I ask you these questions. If the convicted offender is a 40+ year old man and the 16 year old was the friend of his daughter, would the 30 years be a "cruel and unusual" sentence and worthy of granting asylum and denying extradition back to the US? How about if the convicted offender is a 40+ year old woman and the 16 year old was the friend of her son, would the 30 years be a "cruel and unusual" sentence and worthy of granting asylum and denying extradition back to the US?     The issue isn't how long the sentence is. Canada is granting her asylum for committing a crime in another country. That in itself is wrong. she should be extradited immediately. Not to mention the double standard here is pretty ridiculous. Your gender shouldn't matter in how heavy your sentence is. If this was a male he would be thrown out of Canada pretty quickly.

      At a glance 30 years seems a bit harsh. Since we don't know all the details though it could go either way, if it was consensual then its way too harsh in my opinion. Also the kid was 16, so thats on the border of legal. Hell it is legal here in blighty.

    • The sex of the criminal should never make a difference. Should the punishment be thirty years in prison? I don't know. I have no experience with law in practice or philosophy, but I do not think the accused should be let off easy. The victim may have been "willing", but I think we can all agree that teenagers really have little idea as to what they are doing when it comes to decisions like this. Their brains just aren't fully developed.

    • I don't know. I'm beginning to see his point, as reluctant as I am to say that. This country does pre-judge people who commit "Sex Crimes." And while he was guilty, and what he did was very, very wrong, is it worth 30 years? Especially when the sexes are reversed, the woman gets time served and mandatory therapy instead? Also, 30 years on that charge is a death sentence. When the prison population hears it was a kid, and his daughter's friend, then they tend to take matters into their own hands. As I see it there are more than one kind of sex offender. And time will tell what this guy is. Is he the predator that will one day kill kids after assaulting them? Is he the guy going through a midlife crisis and took his finger off the button for a minute, ala American Beauty? Is he the victim, and she came on to him? (see the movie 13) That does happen. Furthermore, when you make the sex offender's list, in any way, for anything, kiss any job goodbye, kiss buying a house goodbye, pretty much you should just embrace your life of poverty and discrimination. Until you die. Our instinct to protect our children, and a system that states all must be treated the same has made it to where it is cruel and unusual. May it is for him. I don't know.

      • Sorry, If the dude consented (even if the state doesn't legally recognize his consent) then 30 years in prison is a way too harsh sentence in my book. When you're 16 you don't, generally, have the best judgement around but you're sure as hell of age to feel libido and make a legit conscious decision to have sex. 30 years for a crime that didn't actually harm anyone is ridiculous.

                Well, a man in a similar case only got 30 days, and his victim killed herself, so she does have a point that her sentence is unfair.
