Was it a consensual style of sex or did the sober teen force the adult down and -blam!- the adult?
Just because they are 17 doesn't mean that they can't be convicted of -blam!-.

in this example Like in many states. Drunk people ( regardless of age ) are incapable of giving consent. legally neither of them can give consent. The adult cannot because they are drunk. The minor cannot because they are a minor.

Okay so who initiated base on your stats. The courts/lawyers would be trying to prove one way or the other. If the adult had no knowledge and got taken advantage of I feel like male or female would be found not guilty of any wrongdoing. However why are they drinking and associating with any children would be the other question that is asked. It would invoke the possibility that the adult was knowingly putting himself in that situation before he started drinking with the intent of having sex with the teenager.
