This could be due to one of three things...
1. A damaged disc.
Or
2. Corrupted sectors on your hard drive.
Or.
3. Internet issues mainly data loss causing you to not be able to download the game updates and any dlc (remember the dlc is digital only and not on the disc.

I'm leaning towards the disc, would buying the digital collectors edition allow me to use my old data from my original Xbox one still? Or would I need to completely restart?

XB1 to XBx should be fine. It is only the XB360 to XBx which would have problems with characters and dlc licences.
