Recovs are a symptom of an issue, not the cause of an issue. Can't fault people for making a living by providing a service. I could learn how to fix my car, but I don't have the time or patience to, so I pay someone else do it.

  • Sure, if there is money to be made, people will fill that market, but that doesn’t make it right. There are plenty of illegal or immoral markets in the world that any decent person would think poorly of. I’m not trying to compare the two, just pointing out that not all markets are good markets. For the analogy, a more applicable one would be a 1 star landscaper paying a 5 star one to mow their lawn. Not everyone chooses to be a mechanic. Everyone who plays chooses to play Destiny. Besides, Destiny is a game meant for entertainment purposes and is no where near as vital as something like a car.

  • if you and i both buy and f-150 and yours breaks, it has no effect on me when you go to a shop and say "hey here 200$ replace my alternator." when it does affect me, is when you go into that shop with the alternator from my truck that is working perfectly fine and say " can you put this in for me?'' Paid recoveries are to the effect of stealing my alternator to fix your truck. You're actively harming another player so you dont have to deal with it.

  • Car manufacturers expect you to pay somebody to get your car fixed. You're not expected to fit your own car. In gaming, in case you didn't know it, you're expected to do all the goals not pay someone to do that. You have a horrible analogy

  • Terrible analogy. Hell, it's a stretch to even call it an analogy. A car is a necessity. Destiny is a game that people play for entertainment. Paying someone to fix your car doesn't fill the roads with Nascar drivers bumping cars off the road and clogging destinations with professional drivers so that others can't get to work. Paid carries and recovs constantly bump honest players away from their goal(especially in Trials) and greatly upset the balance of grind vs reward. Pve recovs and carries I couldn't care less about. If more people were willing to help out of genuine goodwill there wouldn't even be a market for paid carries. Pvp is where honest players are ACTUALLY affected. I care nothing about petty jealousy caused by "but he paid to get 1000 voices!"

  • I can fault them, its blatantly against the LSLA and for good reason. Bungie just needs to actually crack down. They used the same grounds of how paid services are against the LSLA to send the cease and desist to the cheaters, they can do the same thing to carries. Because its a paid service. That they didn't authorize. And by breaking LSLA, the terms they have laid out also means you're break US copyright law by providing these services. I see you said to someone else to ask for proof. See paragraphs 6, 7, and 9 of the LSLA (Limited Software License Agreement)
6. LIMITED USE LICENSE: Bungie grants you the non-exclusive, personal, non-transferable, limited right and license to install and use one copy of this Program solely for your non-commercial use. All rights not specifically granted are reserved by Bungie. The Program is licensed, not sold, for your use. Your license confers no title or ownership in this Program, and should not be construed as a sale of any rights in this Program. This Agreement shall also apply to patches or updates you may obtain for the Program, unless that patch or update is accompanied by additional terms as provided in the section regarding “Changes to the Agreement” below. Any use of the Program in violation of the License Limitations will result in an immediate termination of your license, and continued use of the Program will be an infringement of Bungie’s copyrights in and to the Program. VIOLATION OF THESE LICENSE CONDITIONS BY YOU OR ANY THIRD PARTY USING YOUR ACCOUNT MAY RESULT IN A SUSPENSION OR BAN, IN ADDITION TO ALL OTHER REMEDIES AVAILABLE TO BUNGIE.

9. These are written by Bungie, breaking these requests breaks ToS, not the law. Stop giving companies and corporations more power than they deserve.

  • IT LITERALLY SAYS IN THE LSLA THAT COPYRIGHT LAW IS APPLIACABLE TO BREAKING THIS
This Program is protected by the copyright laws of the United States, international copyright treaties, and conventions and other laws. This Program contains certain licensed materials, and Bungie’s licensors may protect their rights in the event of any violation of this Agreement.
You are unbelievable and clearly didn't read a word of that.

  • Streaming/youtube vids are indeed in breach of copyright law. However as they tend to offer more benefits (free publicity, community building etc) they get a pass. In comparison, paid recovs/carries can feel very offputting to players. I mean, imagine being a newish player wanting some help to tackle higher end content and being met with a wall of people demanding money? Thats harmful to the franchise and a reasonable reason why Bungie should choose to enforce the law in this regard.

  • You should think before you respond, I just posted Bungie's (and what is also most game companies) own words. Don't shoot the messenger first of all. Second of all, YouTube, Twitch, and similar platforms are protected in that regard as are their creators (as long as they follow the direct TOS/LSLA/EULA for whatever they're playing. Why? Because its news, guides, showcases, etc. Thats well within fair use, especially since in this instance Destiny 2 is a published game. Just like how I could make something commenting on a published book and showcasing it, I could the same for Destiny. Plus its free promo and Bungie wants that. Game devs want that. They have no reason to pick a fight with the entire internet over fair use, that almost went extremely south for one of the largest governmental bodies in the world and that not even being in the US. Yes Im talking about the EU. Over here, that's starting to get into infringing first amendment for the vast majority. Bungie has zero reason to try and fight that. Same with all the other game devs. Next, if you keep going down this then what about game journalists? And all the people using social media like Twitter and Reddit? What, just going to kill the community and actively discourage doing anything at for others? I could keep going on and on. Its people talking and sharing information thats available to everyone, nobody has a problem with that. It fosters community, helps move more players further along, helps keep interest, and provides free promotion. It also gives them insight into their development and what they're doing right and wrong. And then look at this quote, from a CBC article (and was probably wired to other outlets and can be found in other articles) "We tend to think of streamers as just another facet of our community, and they play a role in exposing the game to new players who may then decide to pick the game up for themselves," said Raphael van Lierop, co-creator of The Long Dark. Honestly dude, good lord. You need to think before you try to be all smart with someone who knows full well what they're talking about, how these rules work, and so forth. Don't respond.

  • They break the EULA and copyright laws. It has and continues to be held up in court. Multiple recovery websites/services have been sent cease and desist notices from Bungie, which has either caused a court hearing or the service being removed.

  • There are a bunch of court cases involving eula: Feldman c. Google Inc, ProCD Inc v. Zeidenberg, Brower v. Gateway. EULAs generally are legally binding as long as both parties agreed to them.

Wrong. Maybe in the Woke States O of America, but not according to EU law. German law states that if a part of the contract (EULA) goes agianst other laws or is moral wrong (vice laws), the whole contract is Null and Void. Edit: The part in the EULA were I can not sue Bungie makes the whole EULA non valid. Think of that.
