Have you tried running an extended line test? Give that a go and see if it uncovers some instability in your connection.
The only other thing that springs to mind is changing your DNS to that of Googles. I dont know how it helps, but a friend of mine who is a networking whiz suggested it in a megathread he made about connection optimization on the CoD forums way back when.
As for whether its fair etc... its either you, or the other 7 to 11 players who suffer. Its not hard to see which way Bungie will sway on that. Its also perfectly possible to lag balls without actually realising it. Its happened to me a few times - once due to "Traffic Management" from my ISP, other times my router shat the bed and needed to be powercycled.

+1 for this I have a clan mate who is a network engineer (or something similar, the guy makes 6 figures working for Stanford and just turned down an offer from google so he wouldn’t have to uproot his family) He also said using googles DNS helps
