First amendment protects your right to speak against the government, not saying things on a forum owned by a company with a term of service agreement. It's kinda like getting a citation for foul language, you may have the freedom of speech...doesn't mean you can say what ever you want.

You can say whatever you want whenever you want, that doesn't mean there are no repercussions. Can you peacefully protest in the streets without repercussion? Yes, if you're not breaking other laws. Can you post whatever you want online? Yes, as long as you're not breaking the terms of service you agreed to by making a bnet account. You wont be punished in either scenario for saying what you want. But if you're diturbing the peace by blocking traffic, or if you've violated code of conduct by posting about potential upcoming content, you will be punished accordingly. Your 1st ammendment rights have not been violdated, but you have been punished for the other rules you've broken.
