If it WAS fake, then it could be viewed as slander. I'm a huge advocate for freedom of speech, but certain kinds of speech count as assault, and if Bungie deemed the post as slander, then they could easily say it was an assault on their company and reputation. I know, it sucks and it's kind of BS, but that's how law works here in the U.S. Edit: it it was REAL, on the other hand, then it was a violation of the NDA that Bungie's employees all signed as a part of their employment. If you sign an NDA, you are authorizing the issuer of the agreement to limit your freedom of speech if it could potentially cause damage or disruption to the issuer.

  • Well, it's a murky area. I mean, OP didn't sign the NDA, so he is under no obligation to respect it. However, the information was passed on from someone who DID sign the agreement, and the information is Bungie property, so to speak. So deleting the post would be within their rights as it would be protection of intellectual property. HOWEVER if OP was then banned and possibly punished in other ways as well, then i would think HIS rights would have been encroached upon.

  • There you go. So it is more less protecting intellectual property, even though it doesn't explicitly state that. Basically they own the forums, and if you use the forums, you agree to use them in a way that isn't damaging towards Bungie. *shrug* My business law is a little rusty, heh.
