Agreed. Why even make the weapon to begin with? The weapon's existence alone just pisses all over the whole "Year 1 Legendaries stay behind in Year 1". Let's nerf Black Hammer, then tell the players to leave it behind in Year 1, then let's make a year 2 version of it, but wait, let's nerf that too. Asinine.
