Seems like the issue is you need to make $40 and pony up to the table. I mean you clearly like the game and want to continue playing it, just get the taken king and call it a day.
But you should know that this isn't a trend that's going to end. Every new DLC and expansion is going to cost money and inevitably lock you out of content if you don't buy it. If it is that much of an issue for you, maybe it's time to cut your losses and pick a new game.
As far as the legality goes it's perfectly legal. You agree to the terms of service. You're an end user, meaning they own the game and let you play it.

You purchased a license to use a product that was liable to be changed at any given time with 0 input from you, the user There is no above law of land here, you signed up for a service and are still able to use said service. If they stop making money then servers get shutdown and sorry bout ya. You can cry, play something else or spend the money to keep going foward, your pick.

You quoted legality by referencing the terms of service. I simply pointed out the terms of service is not legally binding if a court of law considers any part of the, "contract" to be deemed unreasonable. Much as you may think that a terms of service allows a company/service provider to change content at any time without user input it doesn't. Statutory rights still apply.

What part isn't? Heroics? End game. Iron Banner? End game. Nightfall? End game. Daily mission? End game. The end game content is just that. If you want to get to the end game content, gotta upgrade.

Sepkis prime as nightfall should still be available and be tuned to lvl 34 as should any other vanilla nightfall strike.
