Once upon a time I think you were on point. In an environment where games are played online and require 24/7 monitoring and maintenance with regular updates to keep people playing you can make a fine argument that they are a service. The EULA which makes you agree to the terms of [i]service[/i]also sort of imply there is a service involved as well.
