If you sign a contract while under the influence of any drugs or alcohol, it is considered null and void. Same goes for verbal consent.

But how is it fair to punish someone for drunk driving? They aren't responsible for their actions.

They became responsible for any actions when they got drunk in the first place.

I totally agree, but if someone can't give consent drunk then how can they be punished for drunk driving? That's the question I'm asking.

If you drink and drive, it's your fault, and your fault only. If you drink and give consent, yes it's your fault you gave consent, but the other person should know that you're drunk, and so they're still taking advantage of you. That's how I think of it at least. The whole consent thing is a big moral gray area though, depending on how drunk the person is, so there's no really good answer in my opinion.

That would be the difference in criminal and civil action. The contract is a civil matter but the driving is criminal so its not protected

Yes but that civil matter becomes criminal since then they could charge the other person with -blam!- even though they had consented while drunk
