These players aren't hindering their connection to Xbox Live or PSN. They are quitting the game client. They aren't doing anything to the server except forcing it to change hosts.
I agree it's totally cheating but it's not an Microsoft or Sony issue. It's purely up to Bungie to enforce anything.

Ahh yea you're talking about that way of glitching you can also do it by pulling the Ethernet cable that's why I said psn and Xbox live
