  • Actually he's not. The laws here have been extended to digital content so they ARE walking a very shaky line if they intend to give you random or duplicate stuff for real money.

    Except those also gave some consumables. Consumables are one time use and can be used even as you have multiples. That lands it on the good side of that fine line. Another example is fifa ultimate team that sells you random player cards, but since those cards have a value and can be sold in the game for an advantage, this too sits on the good side of that line. Emotes aren't consumable, they have literally no value to have as a duplicate. Also they can't be sold as of now, so you can't benefit of getting a rare one for example. That would land it on the wrong side of that line. Unless it doesn't do duplicates ofcourse, then they'd be fine again. I think these rules apply across more EU countries btw.

  • Technically they didn't. You were guaranteed a random legendary mask but in the paid packages, could dismantle duplicates to give you glue to make any other rare mask into a legendary so you never lost out if you dismantled. If you look in your inventory (if you bought any masks) the glue is still available all be it with no actual use to you now. You could then do in-game free activities to acquire the masks you didn't have in rare form and use the glue you got from the dismantle of the legendary duplicate to make those rares permanent. You will notice that nothing you got from the paid for packages was destroyed after the festival. Be that the spawn in blood vial, the pumpkins, the legendary masks or the glue from dismantling them. This model doesn't work with the emotes for two reasons. 1. The emotes can't be dismantled to get their value back as silver. 2. Duplicate emotes are useless to the player as you can only have one of each emote and a duplicate would literally not even appear. This would mean that it is possible to open a package you have paid for and get nothing. THIS WOULD BE ILLEGAL! 3. You would have to be able to refund the purchase if the player is not happy with it. This rule does not apply to consumables but, does apply to permanent object. 4. Bungie would need to make it 100% clear that you couldn't get any money back if you got nothing. Our consumer laws would have a field day if that were in any way hidden. 5. You can't sell such packages to minors.

Do you know those panini stickers ? or ( as an american ) those deck cards ( NBA or NFL ..whatever) . How many times did you get duplicates in those ? They are still being sold implying that this type of buisness model is legal.

  • You can trade the extras you get, and thus each card at least has some value. You can trade unwanted duplicates for what you don't have with others, or even sell it if it's rare enough.

  • The option to trade and sell is still there. Plus each sticker has an actual monetary value. I think 0.00001 or something. With no trading in destiny you can't. It's a pretty grey area though no matter which way you cut it.

  • There are already a couple of games working like this. So, probably not illegal. But as the method is becoming increasingly popular, it might come under more scrutiny.

  • If you buy packages that give you random items and there's a possibility for you to not get anything worth that money, it's gambling and considered illegal to minors. Although there might be some conditions I'm not aware of.
