Of course. Regardless of what rules and regulations they break. As long as it helps them clear orbit by the time it comes to fight, then it is justified in their eyes.

They will look back at the Earth fighting for its life, and think all they have done that hinders the Earth from fighting back is okay because through [u]their[/u] eyes, they are the ones who do not need to fight. They are not risking their lives to save innocent ones. They are running to save their own.
