I can see where you're coming from, I've played vanilla Destiny on and off since launch but never too seriously. So I didn't want to invest in tdb or how when they dropped; being barred from some events but able to see them/their quest givers and the new items was a little frustrating.
Unfortunately for those of us who don't want to or can't update to the latest content Destiny is a shared world game and to evolve the storyline some of the existing quest givers change roles slightly and with a higher level cap the endgame content shifts.
Not to get too involved in your legal dispute, American law isn't my forte, but I have dealt with a lot of consumer contracts law and online games are very much entitled to change content without notice. Bungie have been pretty upfront about all the changes.
