The clerk doesn't marry them, just signs off on the paperwork. It's a government job, not s religious one. If she was a minister then she'd have the right to not perform the wedding for religious reasons. But, she's a clerk of the government. And in jail now.

Not all religions work that way. You are called into certain positions in the church in some religions.
