Difference between this and Topeka is that they didn't have a religious basis which is protected by the constitution. A Federal Law cannot overrule a Constitutional right. Correct me if I'm wrong. Now she has a right to freedom of religion. Her religion prevents her from giving those licenses to gay couples. It can be concluded that it is unlawful for her to refuse those licenses but it is unconstitutional to punish her or force her to do it.

  • The Supreme Court ruled that gay marriage is a right protected by the 14th amendment

  • Federal Law can modify Constitutional Amendments. Like how we have Freedom of Speech, yet can't yell "Fire" in a crowded theatre. Again, you can practice what you want, as long as it doesn't infringe on Federal Law or the rights of others.

Keyword: Can It hasn't. And by that logic, we shouldn't infringe on this woman's beliefs.

  •
Keyword: Can It hasn't.
Did I not just give an example?
And by that logic, we shouldn't infringe on this woman's beliefs.
Yes, but Federal Law takes precedence over religion. That part is covered by the "Separation of Church and State" clause. In 1878, the Supreme Court was first called to interpret the extent of the Free Exercise Clause in Reynolds v. United States, as related to the prosecution of polygamy under federal law. The Supreme Court upheld Reynolds' conviction for bigamy, deciding that to do otherwise would provide constitutional protection for a gamut of religious beliefs, including those as extreme as human sacrifice. So, as you can see, Federal Law can restrict religious beliefs.
Separation of Church and State clause means that no Law can be made with influence of Religion.
So, as you can see, Federal Law can restrict religious beliefs.
Can it restrict this one then?

  •
Can it restrict this one then?
Yes. No one is being forced to hand out marriage licenses considering how you can always quit if you disagree with the law.

  • But you're forcing someone to quit because of their religious beliefs?

  • No, that's only their reason behind them not doing their job. Not doing their job is the basis for them getting fired.

  • I'm sorry, who's the one that's been using a circular argument? It's abundantly clear the only reason you instigated this dialogue is because you just wanted some vindication. And please, prove me wrong.
